Personal information we may collect
The information required depends on your enquiry, transaction and our legal obligations. It may include:
- your name, contact details, residential address and date of birth;
- property, contract, transaction, finance and settlement information;
- identity documents, identity-verification results and information required for customer due diligence;
- information about how a transaction is being funded and, where required, source of funds or source of wealth;
- tax, banking and other information reasonably required for the conveyancing matter; and
- communications and records relating to your enquiry or matter.
How we collect information
We generally collect information directly from you. We may also receive information from your authorised representative, estate agent, lender, broker, the other party’s representative, identity-verification providers, property and government registries, search providers or other organisations involved in the transaction.
The website enquiry form prepares an email on your device. The website does not submit or store the answers you enter. If you choose to send the email, the information is collected through our business email service, Zoho Mail.
The interactive checklists save your ticks, matter details and notes in the browser storage of the device you use. The checklist information is not submitted to The Conveyancing Team. If you choose “Prepare email” and then send that email, the included information is collected through Zoho Mail. Clearing browser data, using private browsing or changing device or browser may remove or make the locally saved checklist unavailable.
Why we collect and use information
We may collect, hold, use and disclose personal information to:
- respond to enquiries, check whether we can assist and prepare a quote;
- provide conveyancing services and communicate about your matter;
- verify identity and carry out customer due diligence;
- meet legal, regulatory, professional, insurance, accounting and record-keeping obligations;
- complete electronic settlement, duty, registration, search and certificate processes; and
- protect clients and the business from fraud, misuse and security threats.
If required information is not provided, we may be unable to accept an engagement, continue acting or complete a required step.
Who information may be disclosed to
Where reasonably necessary for your matter or required by law, information may be disclosed to service providers and organisations such as identity and AML screening providers, PEXA or another electronic lodgment network, Land Use Victoria, the State Revenue Office, the Australian Taxation Office, search and certificate providers, banks and lenders, estate agents, the other party’s representative, professional advisers, insurers, auditors, regulators and law-enforcement bodies.
Some technology or cloud providers may process or store information outside Australia. Where an overseas disclosure is likely, we take reasonable steps required by applicable privacy law and identify relevant countries where practicable. You may contact us for current information about service providers and overseas handling relevant to your matter.
Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Please do not send identity documents or bank details through the website enquiry. We will explain how to provide sensitive information securely when it is required.
Information is retained for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, professional and record-keeping obligations. When information is no longer required, reasonable steps are taken to destroy or de-identify it, subject to those obligations.
Access, correction and privacy complaints
You may ask to access or correct personal information we hold about you. You may also raise a privacy question or complaint using the contact details below. We may need to verify your identity before dealing with a request.
We will consider and respond to a privacy complaint within a reasonable time. If you are not satisfied with our response, you may be able to contact the Office of the Australian Information Commissioner .
